Terms and Conditions

§ 1. Scope of the General Terms and Conditions
These General Terms and Conditions apply to contracts for the rental of holiday apartments for accommodation purposes.

§ 2 Booking / Booking Confirmation
Please submit booking requests via the booking inquiry form or send them in writing to the provided email addresses or call us.
If we can provide you with the desired holiday apartment for the requested period, you will receive a written confirmation of the booked holiday apartment from us. The reservation for the holiday apartment becomes legally binding upon receipt of the booking confirmation and after the deposit has been paid (see §3).

§ 3 Terms of Payment
The deposit amounting to 20% of the total amount must be transferred to the specified account after receiving the booking confirmation. The final payment is due no later than 30 days before arrival. For short-term bookings, it is due immediately upon receipt of the invoice.

§ 4 Arrival and Departure
On the day of arrival, the holiday apartment is available from 4:00 PM. Information regarding the key handover procedure will be communicated to you by email prior to the start of the trip.
On the day of departure, the apartment must be vacated by 10:00 AM.

§ 5 Holiday Apartments
The holiday apartment is handed over by the landlord in an orderly and clean condition with complete inventory. If any defects exist or occur during the rental period, the landlord must be notified immediately. The tenant is liable for any damage caused by them to the rental property and inventory, e.g., broken crockery, damage to the flooring or furniture. This also includes the costs for lost keys.

The inventory is to be treated with care and consideration and is intended to remain in the holiday apartments only. Rearranging furnishings, especially beds, is prohibited. The tenant is also liable for the fault of their fellow travelers. Damage caused by force majeure is excluded from this. In the event of contractually unauthorized use of the holiday apartment, such as subletting, over-occupancy, disturbing the peace, etc., as well as non-payment of the full rental price, the contract may be terminated without notice. The rent already paid shall be retained by the landlord.
If liability insurance exists, the damage must be reported to the insurance company. The landlord must be provided with the name, address, and policy number of the insurance company.

§ 6 Pets
The accommodation of pets of any kind in the holiday apartment is only permitted with the prior written consent of the provider.

§ 7 Stay
The holiday apartment may only be used by the persons listed in the booking. If the apartment is used by more persons than agreed, a separate fee must be paid for them, which is determined in the rental price.

§ 8 Cancellation
In the event of a withdrawal from the rental agreement, the tenant is obliged to pay a portion of the agreed price as compensation. Cancellation must be made in writing. The amount of compensation depends on the time remaining until the arrival date and is as follows:

up to 60 days before the arrival date: 20% of the agreed price
up to 30 days before the arrival date: 60% of the agreed price
up to 7 days before the arrival date or in case of no-show: 100% of the agreed price

Taking out travel cancellation insurance is recommended.

§ 9 Cancellation by the Landlord
In the event of a cancellation on our part due to force majeure or other unforeseeable circumstances (such as an accident or illness of the hosts) as well as other circumstances beyond our control that make fulfillment impossible, liability is limited to the refund of costs. In the event of a justified cancellation, the customer has no claim to damages. Liability for travel and hotel costs is not assumed.
Cancellation by the landlord can take place without notice after the start of the rental period if the tenant persistently disturbs other tenants despite a warning or behaves in such a breach of contract that the immediate cancellation of the rental agreement is justified.

§ 10 Liability of the Landlord
The landlord is liable within the scope of the duty of care of a prudent businessman for the proper provision of the rental property. Liability for any failures or disruptions in the water or power supply, as well as events and consequences caused by force majeure, is hereby excluded.

§ 11 Use of Internet Access via Wi-Fi

§ 11.1. Permission to Use Internet Access via Wi-Fi
The landlord maintains internet access via Wi-Fi in their holiday property. They permit the tenant to use the Wi-Fi access to the internet for the duration of their stay in the holiday property. The tenant does not have the right to allow third parties to use the Wi-Fi.
The landlord does not guarantee the actual availability, suitability, or reliability of the internet access for any particular purpose. They are entitled at any time to permit additional co-users for the operation of the Wi-Fi, in whole or in part or temporarily, and to restrict or exclude the tenant's access, in whole or in part or temporarily, if the connection is or has been used abusively, provided the landlord has to fear claims as a result and cannot prevent this within a reasonable time with customary and reasonable effort.

§ 11.2. Risks of Wi-Fi Use, Limitation of Liability
The tenant is advised that the Wi-Fi only provides access to the internet; virus protection and a firewall are not provided. Data traffic conducted using the Wi-Fi is unencrypted. Data can therefore potentially be viewed by third parties. The landlord expressly points out that there is a risk that malicious software (e.g., viruses, trojans, worms, etc.) may enter the end device when using the Wi-Fi. The use of the Wi-Fi is at the tenant's own risk and peril. The landlord assumes no liability for damage to the tenant's digital media caused by the use of the internet access, unless the damage was caused intentionally or through gross negligence by the landlord and/or their vicarious agents.

§ 11.3. Responsibility and Indemnification from Claims
The tenant is solely responsible for the data transmitted via the Wi-Fi, the paid services used through it, and the legal transactions conducted. If the tenant visits paid websites or enters into obligations, the resulting costs must be borne by them. They are obliged to comply with applicable law when using the Wi-Fi. In particular, they will:
Not use the Wi-Fi to retrieve or distribute immoral or illegal content;
Not unlawfully reproduce, distribute, or make available any copyrighted goods;
This applies in particular in connection with the use of file-sharing programs;
Observe applicable youth protection regulations.

The tenant shall indemnify the landlord of the holiday property against all damages and third-party claims based on illegal use of the Wi-Fi by the tenant and/or a breach of this agreement; this also extends to costs and expenses associated with the claim or its defense. If the tenant recognizes or must recognize that such a legal violation and/or breach exists or is imminent, they shall inform the landlord of the holiday property of this circumstance.

§ 12 House Rules, General Rights and Obligations

(1) The guest is obliged to comply with the house rules. Night rest applies from 10:00 PM to 7:00 AM. To avoid disturbances, TV and audio devices must be set to room volume.

(2) Smoking is generally prohibited in the holiday apartment. Smoking is only permitted on balconies and terraces.

(3) There is only one car parking space in front of the house for each apartment. Additional cars must be parked in a public parking lot (only a 50m walk away).

§ 13 Written Form
No agreements other than those listed in this contract exist. No verbal agreements have been made. The general terms and conditions are accepted upon transfer of the deposit.

§ 14. Severability Clause
Should one or more provisions of these General Terms and Conditions become invalid, the validity of the remaining provisions shall not be affected thereby. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose pursued by the invalid provision.

§ 15 Place of Jurisdiction
The place of jurisdiction is Bern.
